Distance Sales Agreement

1. Parties

Seller: Novatek Kompozit Sanayi ve Ticaret Anonim Şirketi (trading as "Novatech Composites") — info@novatechcomposites.com · +90 312 433 00 30 · Ankara, Türkiye.
Buyer: the person or entity identified in the order form.

2. Subject

This Agreement governs the sale and delivery of products ordered by the Buyer on magaza.novatechcomposites.com, under Turkish Law No. 6502 on Consumer Protection and the Distance Contracts Regulation. Where the Buyer acts for commercial or professional purposes, consumer legislation does not apply and the Turkish Code of Obligations and Commercial Code govern.

3. Product, Payment, Delivery

Product details, quantities and prices are as shown in the order summary. Listed prices are NET. Orders delivered within Türkiye are invoiced in Turkish lira and Turkish VAT (KDV) is added as a separate line at checkout. Export orders (delivery outside Türkiye) are VAT-exempt under the Turkish VAT Law (export exemption); no VAT is charged or added.
Payment is collected in advance by credit/debit card via the PayTR secure payment platform.
Shipping costs are calculated at checkout and borne by the Buyer unless stated otherwise.
In-stock items ship within thirty (30) days of payment confirmation. For pre-order items the delivery time shown on the product page is an estimate only and may change with the production schedule; exceeding the estimate does not by itself entitle the Buyer to compensation. The Seller is not liable for delays caused by force majeure.

4. Right of Withdrawal

Consumers may withdraw within fourteen (14) days of delivery by writing to info@novatechcomposites.com. Returned goods must be complete, undamaged and resalable, with invoice and original packaging.

5. Exceptions — No Withdrawal

Under Article 15 of the Distance Contracts Regulation, withdrawal is not available for:

Made-to-order goods, including pre-order devices (e.g. Flovv-e) once production has started;
Chemical and consumable products whose packaging/seal has been opened after delivery (resins, foams, silicone rubber, pigments, cleaning fluid, mold release etc.), for health and hygiene reasons;
Industrial systems whose protective packaging has been opened, that have been installed, operated, or exposed to chemicals — such units lose their resalable condition and are not accepted for return to the maximum extent permitted by law;
Buyers not qualifying as consumers (commercial/professional purchases).

Mandatory statutory consumer rights remain reserved.

6. Defects & Damage

Statutory rights for goods proven defective at delivery remain reserved. Carrier damage must be recorded with the courier at delivery and reported within 48 hours.

7. Jurisdiction

Consumer Arbitration Committees are competent within the monetary limits announced by the Turkish Ministry of Trade; beyond those limits, and for all non-consumer disputes, the Courts and Enforcement Offices of Ankara, Türkiye have exclusive jurisdiction.

8. Effect

By confirming this Agreement electronically at checkout, the Buyer accepts all its terms as of the order date.
